We operate the mobile application Karela Lens - Healthy Choices (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").
Karela Lens is an AI-powered scanner for both food and cosmetic products. Simply snap a barcode or search for products and receive instant, unbiased insights into macros, allergens, health risks, and even cosmetic safety—all within seconds.
These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Ananda Subedi, concerning your access to and use of the Services. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.
All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.), so if your interactions would be subjected to such laws, you may not use the Services. You may not use the Services in a way that would violate the Gramm-Leach-Bliley Act (GLBA).
We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks"). Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties in the United States and around the world.
Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use or internal business purpose.
Except as set out in this section or elsewhere in our Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Legal Terms; (4) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Services; (5) you will not access the Services through automated or non-human means; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use of the Services will not violate any applicable law or regulation.
You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
We accept Visa, Mastercard, American Express, Discover, and PayPal. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. Sales tax will be added to the price of purchases as required. All payments shall be in US dollars, and you authorize us to charge your chosen payment provider upon order placement. We reserve the right to correct pricing errors and to refuse or limit orders.
Your subscription will continue and automatically renew unless canceled. You consent to recurring charges until cancellation. Billing cycle is annual. You can cancel at any time via support; cancellation takes effect at the end of the paid term. We may change fees and will communicate changes per law.
All sales are final and no refund will be issued.
You agree not to: scrape or harvest data; trick, defraud, or mislead users; interfere with security features; infringe rights; upload malware; spam; reverse engineer software; use automated systems; impersonate others; or otherwise misuse the Services.
We may allow you to submit content ("Contributions"). You represent that Contributions are original or you have rights, do not violate third-party rights, and are not unlawful or objectionable. You grant us a license to use your Contributions and agree to indemnify us for violations.
We may access, store, process, and use any information you provide. You retain ownership of your Contributions, and by submitting feedback you grant us unrestricted rights to use it.
We grant you a revocable, non-exclusive license to install and use the App on devices you own. You may not reverse engineer, modify, or distribute the App or use it for unauthorized purposes.
When using the App via Apple Store or Google Play, additional distributor terms apply, and each distributor is a third-party beneficiary of these terms.
You may link Third-Party Accounts to import content. You authorize us to access and display your content and contacts. We are not responsible for third-party content or availability.
We allow advertisers to display ads; we provide space but have no endorsement or liability for advertiser content.
We may monitor, restrict, or remove content and manage the Services to protect our rights and ensure proper functioning.
These Legal Terms remain in effect while you use the Services. We may deny or terminate access at our sole discretion without notice or liability.
We can modify, suspend, or discontinue the Services at any time without liability. We are not liable for any downtime or changes.
These Legal Terms and your use of the Services are governed by Delaware law, without regard to conflict of law principles.
Disputes are first subject to 30-day informal negotiations. Unresolved disputes proceed to binding arbitration under AAA rules in New Castle County, Delaware. Arbitration is individual, not class-based. Certain disputes (e.g., IP, injunctive relief) may bypass arbitration.
We may correct errors, inaccuracies, or omissions on the Services at any time without notice.
Services are provided "AS-IS" and "AS-AVAILABLE". We disclaim all warranties and are not liable for any errors, injuries, or damages arising from your use.
To the fullest extent permitted by law, our liability is limited to the amount paid by you to us in the 12 months preceding the cause of action. We are not liable for indirect or consequential damages.
You agree to indemnify us and our affiliates for any losses arising from your use of the Services or breach of these Legal Terms.
We maintain data you transmit to the Services but are not liable for loss or corruption of your data.
You consent to electronic communications and signatures and waive any requirement for non-electronic records.
If complaints are not resolved, California residents may contact the California Dept. of Consumer Affairs.
These Legal Terms, together with policies posted on the Services, constitute the entire agreement. If any provision is unenforceable, the remainder remains in effect.
